1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the emmjen mobile application (the “App”), provided by Device Smart Ltd. By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Description of the App

The App is a Bluetooth-enabled configuration tool designed to connect to a compatible fuel cell system via a Bluetooth adapter. The App allows users to:

• Configure and set fuel cell operational parameters
• Set start and stop voltage thresholds
• Configure fuel cell tank height parameters

The App does not directly control fuel delivery, electrical output beyond configuration parameters, or perform autonomous operation of the fuel cell.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for its intended purpose on a device that you own or control.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law
• Use the App in a manner that could damage, disable, or impair the fuel cell or related equipment
• Circumvent or bypass any security or technical limitations of the App

6. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• The App will be error-free or uninterrupted
• Bluetooth connectivity will always be reliable
• Configuration changes will be appropriate for all fuel cell systems or operating conditions

7. Safety and Operational Responsibility

You acknowledge that:

• Fuel cell systems involve electrical, chemical, and mechanical risks
• You are solely responsible for verifying all configuration settings before operation
• Device Smart Ltd. is not responsible for damage to equipment, property, or persons resulting from improper configuration or use of the App

The App is not a safety-critical control system and should not be relied upon as the sole means of monitoring or controlling fuel cell operation.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall Device Smart Ltd. be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, equipment damage, or system failure, arising out of or related to your use of the App.

9. Updates and Modifications

We may update or modify the App at any time, including adding or removing features. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination, the license granted to you will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
